For Users (Buyers)
1. Service Nature Statement
KongfuMall is a platform providing cross-border shopping and purchasing agency services, dedicated to helping overseas customers conveniently purchase high-quality goods from China.
The platform itself does not produce or manufacture any goods, but solely provides intermediary services such as product selection, procurement, quality inspection, warehousing, and international shipping.
2. Product and Transaction Liability
- Product information (including images, descriptions, prices, etc.) is provided by partner merchants.
KongfuMall assumes no legal responsibility for its authenticity, legality, or intellectual property ownership. - Before purchasing, users should carefully review product details and after-sales terms to confirm specifications, intended use, and compliance.
- In disputes arising from product quality, improper use, or discrepancies with descriptions, KongfuMall will facilitate communication but bears no liability for compensation.
3. Logistics and Warehousing
- KongfuMall utilizes third-party international logistics providers for delivery.
Once dispatched, transportation risks (delays, loss, damage, etc.) are borne by the logistics provider. - The platform will assist users with inquiries and claims but is not directly responsible for compensation.
- Standard free storage in the warehouse is 90 days, with a maximum extension of 180 days.
Orders not shipped or with unpaid extension fees beyond this period will be considered abandoned.
4. After-Sales & Refunds
- After-sales policies apply only to products meeting return/exchange criteria (details in the After-Sales Policy).
- KongfuMall reserves the right to deny after-sales service if requests are not submitted within the specified timeframe or if products fail inspection for return/exchange eligibility.
- The platform assumes no liability for losses arising from exchange rate fluctuations, international policies, customs clearance issues, or similar circumstances.
5. User Obligations
- Users must ensure all provided information (including shipping address, phone number, tax ID, etc.) is accurate and valid.
- Users bear sole responsibility for package returns, customs clearance failures, or delays caused by personal reasons.
- Users may not use the platform for illegal transactions, infringing activities, or other violations of import regulations.
6. Exemptions from Liability
KongfuMall shall not be liable under the following circumstances:
- Damage or legal liabilities resulting from users' improper use of goods.
- Force majeure events including natural disasters, war, strikes, epidemics, or policy changes;
- Technical issues arising from third-party logistics or payment systems;
- Delays or returns caused by users providing incorrect information;
For Merchants (Suppliers)
1. Platform–Merchant Relationship
KongfuMall provides merchants with a technical platform for product display, sales, and order coordination.
The platform does not participate in the actual manufacturing or pricing of goods.
Merchants bear full responsibility for the authenticity and compliance of information regarding the products they list.
2. Merchant Responsibilities
- Merchants must ensure all listed products comply with relevant laws, quality, and safety standards in China and the destination country for export.
- Merchants must not publish information about counterfeit, infringing, non-compliant, or falsely advertised products.
- Merchants must proactively address after-sales issues.
Failure to fulfill after-sales obligations may result in the platform temporarily freezing settlement funds or restricting sales privileges.
3. Data and Privacy
- The platform respects merchant privacy, collecting and using data solely for order processing and legal compliance purposes.
- Merchants must not use platform data for malicious competition or abuse customer information.
4. Fees and Settlement
- Merchants must comply with platform service fees, settlement cycles, and refund procedures.
- For violations (e.g., fraudulent shipments, malicious refunds), the platform reserves the right to deduct corresponding amounts and terminate cooperation.
5. Platform Disclaimer
KongfuMall assumes no liability for:
- Complaints, fines, or claims arising from merchant violations;
- Transaction interruptions due to network outages, system maintenance, or policy adjustments;
- Cross-border trade restrictions or losses resulting from changes in laws or policies.
6. Termination and Penalties
- The platform reserves the right to issue warnings, freeze accounts, remove listings, or terminate cooperation with non-compliant merchants.
- In cases of severe violations of platform rules or applicable laws and regulations,
KongfuMall reserves the right to pursue legal action and report violations to regulatory authorities.
Legal Provisions and Interpretation
This Statement applies to all users and merchants utilizing KongfuMall services.
Should disputes arise from the use of this platform, both parties shall resolve them through amicable negotiation. If negotiation fails, the dispute shall be submitted to the People's Court with jurisdiction in the platform's location.
